Domestic Violence Injunctions (Orders of Protection)

 

Domestic Violence is both a civil and criminal offense.  Domestic violence is a general term for illegal conduct directed towards a spouse, former spouse, present or past romantic partner, child or other family member living in the same home.  On many occasions a party will improperly file an application for an injunction in order to attempt to obtain an advantage in a divorce or custody dispute.  On other occasions a party really does need an injunction, but they do not properly plead the necessary requirements to obtain the order or do not know how to get a temporary order.
